Naia Léa's General Terms and Conditions

Article 1 – Definitions

In these General Terms and Conditions, the following terms are defined as follows:

  1. Cooling-off period: The period during which the consumer can exercise their right of withdrawal.
  2. Consumer: Any natural person acting for purposes which are outside their trade, business, craft or profession.
  3. Entrepreneur: Naia Léa, the natural or legal person who sells products through their website.
  4. Distance contract: A contract concluded between the entrepreneur and the consumer exclusively through the use of remote communication means.
  5. Customs duties and taxes: Additional charges that the customer may have to pay upon delivery in the destination country.
  6. Durable medium: Any instrument which enables the consumer or entrepreneur to store information in a way accessible for future reference.

Article 2 – Applicability

  1. These General Terms and Conditions apply to all offers, orders, and agreements concluded via Naia Léa's website.
  2. By placing an order, the consumer agrees to these General Terms and Conditions.
  3. Additional or differing conditions from the consumer will not be accepted unless expressly agreed upon in writing.

Article 3 – The Offer

  1. All offers from Naia Léa are non-binding and subject to change.
  2. Product descriptions, prices, and images are indicative and may differ from the actual delivery.
  3. Obvious errors, typos, or mistakes in the offer do not bind Naia Léa.

Article 4 – The Contract

  1. The contract is concluded once the consumer completes the order and payment has been successfully processed.
  2. Naia Léa reserves the right to refuse orders, for example, in case of suspected fraud.

Article 5 – Prices and Payments

  1. All prices include statutory VAT but exclude shipping costs, customs duties, and other charges.
  2. Payments are made via the payment service providers offered by Naia Léa, including Shopify Payments and PayPal.

Article 6 – Delivery

  1. Naia Léa offers shipping from warehouses in China and the Netherlands. Delivery time may vary depending on the destination.
  2. Average delivery times are 7–21 business days. Delays due to customs or transport companies are beyond Naia Léa's responsibility.
  3. Once the order has been dispatched, responsibility for delivery lies with the transport company.

Article 7 – Customs Duties and Taxes

  1. Naia Léa is not responsible for customs duties, import taxes, or additional costs that may arise in the consumer's destination country.
  2. The consumer is obligated to pay these fees.

Article 8 – Right of Withdrawal and Returns

  1. The consumer has the right to withdraw from the order within 14 days of receipt without giving any reason.
  2. The return shipping costs are borne by the consumer.
  3. Products must be returned unused, undamaged, and in their original packaging.
  4. Customized, perishable, or hygienic products with a broken seal are excluded from the right of withdrawal.

Article 9 – Defects and Warranty

  1. The consumer must report obvious defects within 14 days of receipt.
  2. Refunds or replacements will be offered after inspection of the returned product.

Article 10 – Limitation of Liability

  1. Naia Léa is not liable for delays caused by customs clearance, strikes, or other force majeure circumstances.
  2. Naia Léa is not liable for indirect damages, including, but not limited to, loss of profit, data loss, or business interruption.

Article 11 – Complaints

  1. Complaints must be submitted in writing within 7 days of the problem arising.
  2. Naia Léa will respond to complaints within 14 days.

Article 12 – Data Protection

  1. Naia Léa processes personal data in accordance with data protection regulations and the privacy policy, which can be viewed on the website.

Article 13 – Disputes

  1. Dutch law applies to all contracts between Naia Léa and the consumer.
  2. In case of a dispute, Naia Léa will first try to find an amicable solution.

Article 14 – Final Provisions

  1. Should individual provisions of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid.
  2. Changes or additions to these terms require written form.
